Though each proposal varies in terms of the potential impact on the crypto industry, many suggested that the commission would continue to soften its enforcement approach, establishing safe harbors and restructuring existing regulations to benefit projects.\u00a0<\/p>\n<p data-ct-non-breakable=\"undefined\">\u201cThe agenda covers potential rule proposals related to the offer and sale of crypto assets to help clarify the regulatory framework for crypto assets and provide greater certainty to the market,\u201d said Atkins, adding: \u201c[&#8230;] the agenda reflects our withdrawal of a host of items from the last Administration that do not align with the goal that regulation should be smart, effective, and appropriately tailored within the confines of our statutory authority.\u201d<\/p>\n<p><iframe width=\"100%\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/20zFEDQdKl8?start=\" frameborder=\"0\" allow=\"accelerometer; autoplay; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen loading=\"lazy\"><\/iframe><\/p>\n<p><em><strong>Related: <\/strong><\/em><a data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/news\/sec-crypto-task-force-quantum-proof-digital-assets\" title=\"null\"><em><strong>US SEC\u2019s crypto task force urged to quantum-proof digital assets<\/strong><\/em><\/a><\/p>\n<h2>What\u2019s in the SEC\u2019s agenda?<\/h2>\n<p>Among the proposed rules in the SEC agenda <a data-ct-non-breakable=\"null\" href=\"https:\/\/www.reginfo.gov\/public\/do\/eAgendaViewRule?pubId=202504&#038;RIN=3235-AN38\" rel=\"noopener nofollow\" target=\"_blank\" title=\"null\">was<\/a> including \u201ccertain exemptions and safe harbors\u201d related to the offer and sale of crypto assets, and amending the Exchange Act \u201cto account for the trading of crypto assets on [alternative trading systems] and national securities exchanges.\u201d <\/p>\n<p data-ct-non-breakable=\"undefined\">The modifications could allow crypto companies to operate with less regulatory oversight and reduce the risk of legal action.<\/p>\n<p>Other proposals suggested modifying \u201cbroker-dealer financial responsibility rules,\u201d which could lessen the burden on crypto companies reporting data. <\/p>\n<p data-ct-non-breakable=\"undefined\">Broker-dealer rules have <a data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/news\/sec-broker-dealer-rule-struck-down-us-courts\" title=\"null\">been a point of contention<\/a> for many in the crypto industry by placing Know Your Customer and Anti-Money Laundering regulations on networks, often without the means to gather such data.\u00a0<\/p>\n<p><template data-ct-widget=\"buzzsprout\" data-buzzsprout-podcast-id=\"2040516\" data-buzzsprout-episode-id=\"17715136\"><\/template><\/p>\n<p>Notable, however, were the proposed rule changes suggesting \u201cmodernizing\u201d the SEC\u2019s framework to accommodate cryptocurrencies. <\/p>\n<p data-ct-non-breakable=\"undefined\">The commission proposed the Investment Advisers Act of 1940, which lays out regulations on custody, be \u201cimproved\u201d to address crypto \u2014 less than eight months after a proposed rule change <a data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/news\/sec-axes-biden-era-proposed-rules-on-crypto-in-flurry-of-repeals\" title=\"null\">suggested bringing digital assets under stricter guidelines<\/a> was quashed.\u00a0<\/p>\n<p>Though proposed as part of Atkins\u2019 and the SEC\u2019s agenda, the rules must go through an extensive process before adoption, including a public comment period and review.<\/p>\n<p>Since the resignation of former SEC Chair Gary Gensler on Jan. 20, many of the commission\u2019s decisions represented a complete about-face: dropping years-long investigations and lawsuits and <a data-ct-non-breakable=\"null\" href=\"https:\/\/cointelegraph.com\/news\/tokens-securities-sec-chair-paul-atkins-wyoming\" rel=\"https:\/\/cointelegraph.com\/news\/tokens-securities-sec-chair-paul-atkins-wyoming\" target=\"https:\/\/cointelegraph.com\/news\/tokens-securities-sec-chair-paul-atkins-wyoming\" title=\"https:\/\/cointelegraph.com\/news\/tokens-securities-sec-chair-paul-atkins-wyoming\">issuing statements suggesting it would change<\/a> its approach to enforcement.
