Tim Scott has set a committee vote for next week on the Senate\u2019s crypto market structure bill.<\/li>\n<li>Major issues remain unresolved, including ethics rules, DeFi protections, stablecoin yield, and regulator quorum requirements.<\/li>\n<li>Crypto advocates fear a rushed markup could doom the bill\u2019s chances of passing this year.<\/li>\n<\/ul>\n<\/div>\n<p><span>Sen. Tim Scott (R-SC), chair of the powerful Senate Banking Committee, announced Tuesday he will bring the group\u2019s crypto market structure bill up for a key vote next week\u2014despite concerns that doing so could doom the legislation\u2019s odds of passage this year.<\/span><\/p>\n<p><span>For months, a group of pro-crypto Democrats and Republicans have gone back and forth negotiating language in the sprawling bill, which would establish a regulatory framework for most of the American crypto industry. Crypto groups have spent years, and <\/span><a href=\"https:\/\/decrypt.co\/295639\/2024-story-of-the-year-crypto-money-politics\" target=\"_blank\"><span>hundreds of millions<\/span><\/a><span> of dollars, building bipartisan support for their coveted legislation in Washington.<\/span><\/p>\n<p>But due in part to the bill\u2019s complexity, Senate Democrats\u2014and a handful of <a href=\"https:\/\/decrypt.co\/329397\/trump-ally-crypto-industry-regulation-spilled-urine-sample\" target=\"_blank\"><span>on-the-fence<\/span><\/a><span> Republicans\u2014have refused to acquiesce to calls from the White House and others to vote on it by certain deadlines. First pro-crypto Republicans wanted the bill passed by July; then by October; then by the end of 2025. Each deadline came and went without a vote.<\/span><\/p>\n<p>Now, Scott appears dead-set on having a key markup vote on the legislation by next Thursday, January 15\u2014whether his colleagues are ready or not.<\/p>\n<p><span>\u201cI think it\u2019s important for us to get on the record and vote,\u201d Scott said Tuesday, in an interview with <\/span><a href=\"https:\/\/www.breitbart.com\/politics\/2026\/01\/06\/exclusive-sen-tim-scott-crypto-market-structure-bill-democratizes-economy-to-ensure-affordability\/\" target=\"_blank\"><i><span>Breitbart<\/span><\/i><\/a><span>. \u201cSo, next Thursday, we\u2019ll have a vote on market structure. We have worked tirelessly for the last six plus months making sure that we had multiple drafts available to every member of the committee.\u201d<\/span><\/p>\n<p><span>The vote will determine if the bill can pass out of the Senate Banking Committee\u2014a key hurdle before a final consideration of the bill on the Senate floor. It is currently unclear, however, whether a majority of senators on the committee are prepared to support the legislation in its current form.<\/span><\/p>\n<p><span>Top crypto lobbyists were already <\/span><a href=\"https:\/\/decrypt.co\/352161\/crypto-crystal-ball-2026-will-crypto-lose-fight-market-structure-bill\" target=\"_blank\"><span>skeptical<\/span><\/a><span> the bill would be able to pass this year, even under less hurried circumstances. After Scott\u2019s announcement of an accelerated voting schedule Tuesday, some crypto leaders openly voiced concern about the strategy\u2019s implications.<\/span><\/p>\n<p><span>\u201cYou have to push the markup hearing if it&#8217;s not bipartisan, if there&#8217;s any hope of a deal,\u201d Scott Johnsson, a general partner at Van Buren Capital and frequent crypto policy commentator, <\/span><a href=\"https:\/\/x.com\/SGJohnsson\/status\/2008586956607812080\" target=\"_blank\" rel=\"nofollow external noopener\"><span>said<\/span><\/a><span>.<\/span><\/p>\n<p><span>On Tuesday, Senate negotiators from both parties, along with White House officials, met to discuss Republicans\u2019 \u201cfinal offer\u201d on the market structure bill\u2019s language. A copy of the so-called final offer, first obtained by <\/span><a href=\"https:\/\/subscriber.politicopro.com\/f\/?id=0000019b-9498-df0c-a5bb-b4df90b80000\" target=\"_blank\" rel=\"nofollow external noopener\"><i><span>Politico<\/span><\/i><\/a><span>, lists a number of key issues as still unresolved.<\/span><\/p>\n<p><span>Among them: \u201cethics,\u201d a likely shorthand for the <\/span><a href=\"https:\/\/decrypt.co\/350315\/trump-white-house-worlds-most-corrupt-crypto-startup-operation-house-democrats\" target=\"_blank\"><span>thorny issue<\/span><\/a><span> of conflict-of-interest provisions restricting the ability of the president, members of Congress, and their families, from engaging in crypto ventures. Also listed were \u201cyield,\u201d a reference to existing rules on stablecoin yield that the powerful banking industry desperately <\/span><a href=\"https:\/\/decrypt.co\/336038\/bankers-stablecoin-law-changed-crypto-lobby-no\" target=\"_blank\"><span>wants changed<\/span><\/a><span>, and \u201cquorum,\u201d a likely reference to the Democrat-led <\/span><a href=\"https:\/\/decrypt.co\/343251\/trump-fired-ftc-commissioner-crypto-bill\" target=\"_blank\"><span>plan<\/span><\/a><span> to ensure a bipartisan quorum at federal financial regulators like the CFTC and SEC as the Trump administration <\/span><a href=\"https:\/\/www.economist.com\/united-states\/2025\/12\/10\/the-supreme-court-is-handing-donald-trump-more-power\" target=\"_blank\"><span>erodes<\/span><\/a><span> their independence.<\/span><\/p>\n<p><span>Perhaps most crucially, the document also listed two items central to the regulation and legal protection of decentralized financial software, also known as DeFi, as \u201cto be discussed\u201d: the Blockchain Regulatory Certainty Act, included in the House\u2019s crypto market structure bill, and \u201c18 USC 1960,\u201d the U.S. code that defines <\/span><a href=\"https:\/\/decrypt.co\/336327\/tornado-cash-roman-storm-doj-crypto-charges\" target=\"_blank\"><span>illegal money transmitters<\/span><\/a><span>.
